Default 12 Months for defending his home

I don't even know if this is true or not, but some guy just phoned up Jon Gaunt and said that he caught a burglar in his home, and admits to giving him a real beating. He says he then sat on him and called for the police.

When asked in court if he had remorse for what he'd done, he said, "he'd do the same thing again". He got 12 months in prison for showing no remorse.

The junkie who was robbing him, got let off.

The rule book says that you are allowed to defend yourself, and remove the threat to yourself and your family, but that is all. This guy admitted the beating he gave was excessive.

Was he right or wrong?

I would like to see the story to know what you have heard is the full story.
Was he in court for the burglar's case ?
Or was there charges brought against him ?

I can write my own story and he should have got life in prison......but that is just me being creative.

I heard a very similar story last year except that the occupier was also sued by the robber!

The classic case was Tony Martin emotions run very hot when his name is mentioned.
He did manage to kill with shots to an escaping burglar's back........
English law says enough force to protect yourself........fireing a shotgun into darkness at a fleeing burglar, was judged as too much force.

However, the law did nothing to protect him when he was being harrassed time and time again by the local gypsies. It was no wonder he lost his mind and tried to kill those robbers in the end.

The man was an eccentric nutter living alone........One shotgun blast into the air would have stopped any further visits by the neer do wells.
